1. About These Terms
These Terms and Conditions ("Terms") govern your use of whisky.cab, a digital platform for whisky collection management, price comparison, and community features, operated by Cabinet ("Cabinet", "we", "us", "our").
By creating an account or using any part of this platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
These Terms are governed by the laws of England and Wales.
2. Age Restriction
2.1 Minimum Age Requirement
whisky.cab is an alcohol-related platform. You must be 18 years of age or older to create an account or use this platform. This applies regardless of your country of residence.
2.2 Age Verification at Registration
During account registration, you are required to provide your date of birth. By submitting this information, you confirm that it is accurate. We reserve the right to suspend or terminate any account where we have reasonable grounds to believe the user is under 18.
2.3 Parental Responsibility
If you are a parent or guardian and believe a minor has created an account on whisky.cab, please contact us immediately at legal@cabinet.cab. We will investigate and close the account promptly.
3. Your Account
3.1 Registration
To access the full features of whisky.cab, you must register for an account using a valid email address or via a supported third-party authentication provider (Google, Apple). You are responsible for maintaining the confidentiality of your login credentials.
3.2 Accuracy of Information
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
3.3 Account Security
You are responsible for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.
3.4 Account Termination
You may delete your account at any time via the Settings page. We reserve the right to suspend or permanently terminate your account if you breach these Terms, engage in fraudulent activity, or use the platform in a manner harmful to other users or to Cabinet.
4. The Platform and Its Services
4.1 What whisky.cab Provides
whisky.cab provides tools for: tracking personal whisky collections; discovering products and browsing brand and distillery pages; comparing retail prices across supported whisky retailers; sharing collection data and tasting notes via public profiles (at your discretion); accessing community discovery features.
4.2 Price Comparison and Affiliate Links
whisky.cab displays prices sourced from third-party retailers. When you click through to a retailer from whisky.cab, we may receive an affiliate commission from that retailer. This does not affect the price you pay. We are committed to displaying accurate, current prices; however: prices are scraped periodically and may not reflect real-time changes; we do not guarantee that any price shown is currently available at the linked retailer; Cabinet is not a party to any transaction between you and a retailer.
4.3 Price Accuracy Disclaimer
We make reasonable efforts to ensure price accuracy. However, Cabinet accepts no liability for losses arising from reliance on prices displayed on the platform. Always confirm the current price on the retailer's own website before purchasing.
4.4 No Sale of Alcohol
Cabinet does not sell, supply, or facilitate the direct sale of alcohol. whisky.cab is an information and collection management platform only. All purchases are made directly with third-party retailers.
5. User-Generated Content
5.1 Your Content
You may submit content to whisky.cab including tasting notes, ratings, collection data, photographs, and product information ("User Content"). You retain ownership of User Content you create.
5.2 Licence to Cabinet
By submitting User Content, you grant Cabinet a non-exclusive, royalty-free, worldwide licence to store, display, and use that content for the purposes of operating and improving the platform, including displaying it on public profiles where you have enabled this.
5.3 Content Contributed to the Master Database
When you contribute a product not found in the Cabinet database, that product data (name, distillery, type, ABV, region, etc.) may, upon review and approval, be added to the Cabinet master database and made available to all users. Personal or private notes are never shared in this way.
5.4 Acceptable Content
You agree not to submit User Content that: is false, misleading, or defamatory; infringes the intellectual property rights of any third party; contains personal data of third parties without their consent; is unlawful, abusive, threatening, or harassing; contains malware, spam, or unsolicited commercial communications. Cabinet reserves the right to remove any User Content that breaches these standards, without notice.
6. Acceptable Use
You agree not to use whisky.cab to: circumvent, disable, or interfere with security features of the platform; scrape, harvest, or systematically extract data from the platform without written permission; impersonate any person or entity; attempt to gain unauthorised access to any part of the platform; use the platform for any unlawful purpose; promote or facilitate the sale of alcohol to persons under 18.
7. Intellectual Property
7.1 Cabinet's IP
All content on whisky.cab created by Cabinet — including the platform design, brand identity, logos, copy, and software — is owned by or licensed to Cabinet and is protected by applicable intellectual property law.
7.2 Third-Party Trademarks
Whisky brand names, distillery names, and product names referenced on the platform are the trademarks of their respective owners. Their appearance on whisky.cab does not imply any affiliation with or endorsement of Cabinet.
8. Third-Party Services
whisky.cab integrates with or links to third-party services including retail websites, authentication providers, and analytics platforms. Cabinet is not responsible for the content, privacy practices, or terms of any third-party service.
9. Availability and Changes to the Platform
9.1 Service Availability
We aim to keep whisky.cab available at all times, but we do not guarantee uninterrupted or error-free access.
9.2 Changes to the Platform
We reserve the right to modify, update, or discontinue any feature of whisky.cab at any time.
10. Limitation of Liability
To the maximum extent permitted by applicable law: Cabinet shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the platform; Cabinet's total liability to you shall not exceed £50; nothing in these Terms limits Cabinet's liability for fraud, death, or personal injury caused by negligence.
11. Disclaimers
Cabinet provides whisky.cab on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the platform's suitability for any particular purpose.
12. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify you via email or an in-app notice at least 14 days before the changes take effect.
13. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
